DBA LinkNow Media ("LinkNow®Media") along with its affiliated and subsidiary entities ("LinkNow®Media", "we" or "us") are committed to handle personal information in compliance with applicable privacy and data protections laws, including the Act respecting the protection of personal information in the private sector (the "LPRPSP"), and other provincial or federal laws applicable to the protection of personal information. We strive to be transparent about the data we collect, how it is used and with whom it is shared.

We recognize the importance of protecting your personal information and are concerned about how we handle this information. Therefore, LinkNow®Media undertakes to only collect, use, communicate, and retain personal information about you that is necessary to carry out its activities and services, including in the context of employment, customer knowledge, collection, consultation, and business relations.

This Privacy Policy applies to visitors or users of all LinkNow®Media websites, including but not limited to the https://www.linknow.com website ("Site"), applications, and services (each a "Property" or, collectively, "Properties") as well as to all who communicate with us by phone, text, email, mail or in person (all collectively refer to as "you" or "Users"). Our Privacy Policy explains how LinkNow®Media collects, uses, maintains and discloses your personal information with respect to the Properties and the products and services we offer. These Properties, products and services may be subject to change from time to time in LinkNow®Media’s sole discretion.

LinkNow®Media is not established in the European Union and does not offer services to or target the offering of services to European data subjects. The Properties are operated in Canada and by using the Properties and/or any other service provided by LinkNow®Media you consent to the application of the laws of the province of Québec, including Canadian data protection laws, without reference to its conflict of laws principles.

The Properties, including the Site, are solely intended for use in the trade, i.e., for a sole proprietorship, partnership, limited liability company, corporation, association, or other for-profit legal entity, or a non-profit or government entity. By accessing and/or using any of the Properties or communicating with LinkNow®Media, you understand and agree that such access and use are exclusively restricted to use in the trade and is not intended for personal use. As a result, you represent and warrant that you will not use the Properties, including the Site, in your capacity as an individual who seeks to acquire goods or services for personal, family, or household purposes. Accordingly, please be aware that rights afforded to consumers, including but not limited to California’s Shine the Light law, and the California Consumer Privacy Law, do not apply in connection with the Properties, including the Site.

For the purpose of this Privacy Policy, "Personal Information" refers to information about an identifiable individual, in accordance with applicable privacy laws. This includes, but is not limited to:

  • Your name, address, telephone number, postal address, and email address;
  • Bank details, credit card numbers, and other billing information;
  • Personal data provided to us as a customer;
  • Details of visits to our websites, including information collected via cookies and other tracking technologies;
  • Technical data, such as the Internet Protocol (IP) address of your computer, and details about your browser and operating system;
  • Information related to recruitment, including curriculum vitae, education, and professional experience;
  • Information provided during registration and participation in training workshops, symposiums, conferences, meetings, or other events;
  • Information relating to marketing preferences and communication choices;
  • Any other personal data about you that you may provide to us.

However, Personal Information does not include the business contact details of an employee or representative of an organization when used to contact that person in connection with their business role. Additionally, aggregated or anonymous information, which cannot be used to identify an individual, is not considered Personal Information under this policy.

By visiting the Properties, registering for the Properties, receiving the Services, communicating with us, participating in a contest or promotion or otherwise providing us with your Personal Information, you consent to our collection, use and disclosure of your Personal Information in accordance with the terms of this Privacy Policy. We encourage you to read this Privacy Policy carefully, and to watch for and read any updates that might be made from time to time, as explained below in Changes. If you do not agree to this policy, please do not visit or use LinkNow®Media Properties and do not use LinkNow®Media’s products or services. Your continued visit of LinkNow®Media’s Properties, including without limitation the use of the Site, products or services following the posting of changes to this policy will be deemed to constitute your acceptance of any such changes.

This Privacy Policy does not cover information that is not personally identifiable, such as anonymous or aggregated data, which cannot be associated with a specific person ("Non-Personal Information"). Non-Personal Information may include, without limitation, information about when and how Users interact with LinkNow®Media Properties, including the Site, demographic statistics about our Users, IP addresses, geolocation information, unique device identifiers, browser type, browser language and other transactional information. This information is typically used by LinkNow®Media, its advertisers or audit bureaus.

How we collect your Personal Information

LinkNow®Media may collect Personal Information from you in a variety of ways, including, but not limited to, when you visit the Properties, including the Site, contact us, place an order, subscribe to the newsletter, fill out a form, through third-party list brokers and in connection with other activities, services, features or resources we make available, on the site, over the phone, by various messaging apps or in person. You may be asked for, as appropriate, a range of Personal Information, including name, email address, mailing address, phone number and credit card information. Users may, however, visit the Properties pseudonymously and users can always refuse to provide personal identification information. Users must however note when visiting the Properties pseudonymously or when refusing to provide certain required information, they may be unable to use certain features of the Properties or the same may not function properly.

LinkNow®Media may also collect Personal Information that may be generated by your registration, participation or use of the Properties, including the Site, and/or Services. As explained below, under Website Usage, we may also collect certain information respecting your use of the Properties, including our Site, such as links clicked through and pages viewed.

How we use collected information

LinkNow®Media collects Personal Information primarily to provide you with its products and services. This includes customizing the Properties, such as the Site, according to your preferences. In addition to these purposes, LinkNow®Media collects, uses, and communicates personal information in the context of its various activities, which extend to employees, customers, and suppliers.

The collection of Personal Information serves multiple objectives including:

  • To enable the efficient provision of services and fulfillment of contractual obligations to customers and other third parties;
  • To enhance user experience and tailor our services to meet individual needs and preferences;

The Personal Information collected by LinkNow®Media is integral to its ability to offer high-quality services and maintain effective business operations. LinkNow®Media is committed to handling this information responsibly, in accordance with its privacy policy and relevant privacy legislation.

More specifically, we may collect and use Users’ Personal Information for a range of purposes, consistent with applicable law and in alignment with this Privacy Policy. These purposes include, but are not limited to:

  • Improving Customer Service and User Experience: We utilize information to enhance our response to your service requests, support needs, and to better understand how our Users collectively interact with our products, services, and site features.
  • Enhancing Our Site and Services: User feedback is critical in refining our Properties, including the Site, and in the development of new products and services.

  • Marketing and Communications: We use personal information to develop, market, and sell our services and products, distribute newsletters, and communicate about training workshops, symposiums, conferences, and other events.

Personal information may also be collected by LinkNow®Media in the context of employment, knowledge of its customers, collection, consultation and business relations.

We ensure that the people affected by this personal information are informed of its collection and that they understand its purposes.

LinkNow®Media may collect personal information using technology that includes functions to identify you, locate you or carry out profiling. In such a case, consent in accordance with applicable laws will be requested from the person concerned if personal information is collected. Information about the use of the Properties and other technical information or visitor interaction with the websites may be collected.

Potential Secondary Uses

As permitted by law, we may also collect, use and disclose some of your Personal Information for purposes not directly connected to your use of the Properties, including the Site, or receipt of our products and services, as outlined below. In some cases, you may choose not to participate in such activities, or not to provide us with your Personal Information. In other cases, you may opt-out of the use of your Personal Information for secondary purposes by contacting us, as set out below under Contact, or as otherwise noted below. For completeness, we also note below a number of practices that involve only the collection and use of aggregated information.

  1. Marketing Communications
    As permitted by law, we may send you email communications that may contain company news, updates, related product or service information, or special offers or promotions from LinkNow®Media, its business partners or other third parties. We send such communications to provide you with up-to-date information about our services, and to publicize and promote certain content, products and services that may be of interest to you. Note that we do not sell, rent or disclose your Personal Information to third parties for their own marketing purposes without your consent.

    You may unsubscribe at any time by contacting us, as set out below under Contact, or by clicking on the "unsubscribe" option in any such email communications you may receive. Note that if you do unsubscribe from marketing and promotional messages, you may continue to receive service and transactional messages, such as those relating to order confirmation, billing and collection, or service modifications.

  2. Online Interest-Based Advertising
    LinkNow®Media has agreements with third-party advertising services ("Advertisers") to present you with advertising on third-party web sites based on your previous interaction with the Properties, including the Site, enabled through your computer browser and "cookies" (for more information on cookies, see Website Usage, below). The techniques that Advertisers employ do not directly collect information tied to your name but could be used to collect information about the activities of your browser and IP address over time and across different Web sites. This information is used to predict and display to you the types of advertising that may be most relevant to your interests and tastes, and may also be used to display ads to you featuring events that you previously viewed on the Properties, including the Site (known as "re-targeting"). You may obtain more information about online interest-based advertising, and opt out of such interest-based advertising (note that by opting out, you will still see advertising – it just may not be for products or services of interest to you), by visiting https://www.youradchoices.ca or https://www.aboutads.info/choices/ and https://www.aboutads.info/appchoices (for information on the DAA’s opt-out program specifically for mobile apps). Note that LinkNow®Media is not responsible for the completeness or accuracy of any third-party information. Opting out only means that those selected members should no longer deliver certain interest-based advertising to you but does not mean you will no longer receive any targeted content and/or ads (e.g., from other ad networks). Also, if your browsers are configured to reject cookies when you visit these opt-out webpages, or you subsequently erase your cookies, use a different device or web browser or use a non-browser-based method of access (e.g., mobile app), your NAI / DAA browser-based opt-out may not, or may no longer, be effective. LinkNow®Media supports the ad industry’s Self-regulatory Principles for Online Behavioral Advertising and expects that ad networks we directly engages to serve you interest-based advertising will do so as well, though we cannot guarantee their compliance. LinkNow®Media is not responsible for the effectiveness of, or compliance with, any third parties’ opt-out options or programs or the accuracy of their statements regarding their programs.

  3. User-Submitted Content
    From time to time, Users may submit testimonials, photographs, or other writings. In some cases, Users may also be given the choice of providing their name and location when providing these submissions, or when responding to customer satisfaction surveys. By providing such submissions, Users consent to LinkNow®Media is using such submissions together with the User’s name, image, likeness, other unequivocal identifiers and location in any and all media to the fullest extent not prohibited by applicable law.

  4. Survey and Third-Party Promotions
    To participate in surveys, there may be a separate registration process which may require the submission of Personal Information (such as your full name, email address, mailing address, telephone number, etc.). LinkNow®Media will use the information you provide for the purpose of the survey (for example, to contact you for additional inquiries), and for the purposes stated in the registration form. You may also have the opportunity to opt-in to receive special promotions or offers from our advertisers ("Third-Party Promotions") as a result of your visit or use of the Properties, including the Site, and/or Services. By entering one of these Third-Party Promotions, you are agreeing to the official rules that govern these Third-Party Promotions, which may include consent to additional or differing data practices from those contained in this Privacy Policy. Please review those rules carefully. LinkNow®Media is not responsible for the compliance of Third-Party Promotions with applicable laws.

  5. Website Usage
    LinkNow®Media’s Properties, including the Site, also automatically collects certain information about visitors to the Properties, including the Site, through various Internet technologies, such as through log files, and through "cookies", "web beacons", "tags and scripts", local storage objects ("LSOs") such as HTML5, and similar technologies that websites or applications commonly write to your computer or device and which contain information that can help identify you each time you visit one of the Properties. The information may include, but is not limited to, the browser name, the type of computer and technical information about Users’ means of connection to the Properties, including the Site, such as the URL of the webpage that led the Users to the Properties, including the Site, if any, the Users’ IP address, the operating system, the Users’ personal preferences such as language, browser settings, bookmarks,, etc., and the Internet service providers utilized as well as any other relevant non-personal information.

    The Properties, including the Site, may also use "cookies" to enhance the User experience. A User’s web browser will place cookies on the User’s hard drive for record-keeping purposes and sometimes to track information about them. Cookies are small text files stored on your device that identify your browser/IP address – but not you as an individual – to our computers each time you visit our Properties, including the Site. More information about cookies can be found at third-party information sites like allaboutcookies.org or en.wikipedia.org/wiki/HTTP_cookie, although note LinkNow®Media is not responsible for the completeness or accuracy of this third-party information. LinkNow®Media may use cookies to create a profile of Users, detailing their stated and inferred preferences, in order to facilitate a more personalized web browsing experience, including by providing more personalized products and services that are tailored to your needs. LinkNow®Media may also use cookies to collect aggregated statistical information about how its Properties, including the Site, and their features are used.

    Some information about your use of the Properties, including the Site, the Service and certain third-party services may be collected using cookies and other tracking technologies across time and services and used by LinkNow®Media and third parties for purposes such as to associate different devices you use and deliver relevant ads and/or other content to you on the Properties, including the Site, the Service and certain third-party services. Note that LinkNow®Media does not have access to, nor control over, the use of tracking technologies by such third parties. As such, the placement of these third-party technologies on your computer or devices is subject to the terms, conditions and policies of such third-party vendors and advertising networks.     Most web browsers contain controls that allow you to block or delete cookies (this is usually done through privacy settings), or to notify you when a request to set one is made. You do not need to enable cookies to visit the Properties, including the Site; however, certain features of the Properties, including the Site, and Services depend on the use of cookies. Accordingly, if you choose to block cookies you may not be able to use those features or may lose preferences based on those cookies.

    Your browser settings may allow you to automatically transmit a "Do Not Track" signal to online services you visit. Note, however, there is no consensus among industry participants as to what "Do Not Track" means in this context. Like many online services, LinkNow®Media currently does not alter its practices when we receive a "Do Not Track" signal from a visitor’s browser.     Log files are records of all visits to the Properties, including the Site, which are automatically generated by its servers or Properties’ hosts. These files make a record of each visit to the Properties, including the Site, and log a number of details, including the IP address from your network, what pages were explored and the length of your visit.

    A web beacon https://en.wikipedia.org/wiki/Web_beacon is a small transparent graphic image that allows us to record simple User actions related to theProperties, including the Site, and to email communications received from us, to help us determine the usage and effectiveness of the Properties, including the Site, and communications. These "images" are automatically loaded to your browser/device when you visit the Properties, including the Site, or open an html format email message from us, thereby letting us know if a certain page was visited or an email message was opened.

    LinkNow®Media currently uses Google Analytics to provide statistics about the visitors to its Properties, including the Site. Google Analytics tracks and analyzes non-personally identifiable statistical information, including, without limitation, search engines, display advertising, pay-per-click networks, email marketing and digital collateral such as links within PDF documents.     Certain functionalities on the Properties, including the Site, or the Service permit interactions that you initiate between the Properties, including the Site, the Service and certain Third-Party Services, such as third-party social networks ("Social Features"). Examples of Social Features include: enabling you to send content such as contacts and photos between the Service and a Third-Party Service; "liking" or "sharing" LinkNow®Media’s content; logging in to the Properties, including the Site, or the Service using your Third-Party Service account (e.g., using Facebook Connect to sign-in to the Properties, including the Site, or the Service); and to otherwise connect the Properties, including the Site, or the Service to a Third-Party Service (e.g., to pull or push information to or from the Properties, including the Site, or the Service). If you use Social Features, and potentially other Third-Party Services, information you post or provide access to may be publicly displayed on the Properties, including the Site, or the Service or by the Third-Party Service that you use. Similarly, if you post information on a third-party service that references the Properties, including the Site, or the Service (e.g., by using a hashtag associated with LinkNow®Media in a tweet or status update), your post may be used on or in connection with the Properties, including the Site, or the Service or otherwise by LinkNow®Media. Also, both LinkNow®Media and the third party may have access to certain information about you and your use of the Properties, including the Site, the Service and any Third-Party Service.

  6. Use of Personal Information for Artificial Intelligence Development.
    We may use the Personal Information and other data collected in accordance with this Privacy Policy to develop, test, train, and fine-tune artificial intelligence models, including but not limited to Language Model (LLMs), algorithms, heuristics, and other machine learning systems. This use is for the purpose of improving our Properties, products, and services, enhancing user experiences, developing new offerings, optimizing our operations, and for other research and development purposes. In such cases, we will take measures to de-identify your Personal Information by removing or altering details that might allow the data to be linked back to you, wherever feasible and appropriate. If not feasible, we will ensure the minimal necessary use of Personal Information in line with the data minimization principle. We will also implement appropriate safeguards to protect the confidentiality, integrity, and availability of your Personal Information throughout this process.

LinkNow®Media uses the above technologies to allow for User preferences, to better understand our business and Users, to determine repeat visitors, validate orders, and detect and prevent fraudulent activity. By using IP addresses to approximate geographic location (to a city level), we can determine approximate time zone and better understand the locations of our customer base. LinkNow®Media will not make any attempt to identify Users according to their browsing activity through such records.

Sharing your personal information

LinkNow®Media may, from time to time, share Personal Information with third parties that we engage to provide services on our behalf ("Service Providers"), such as payment processing, web design and technical support. We will share with such Service Providers only the Personal Information that is reasonably necessary for the purpose or service for which the Service Provider is engaged. In certain cases, these Service Providers may be located outside the province of Quebec, potentially subjecting Personal Information to different legal regimes. In such scenarios, LinkNow®Media ensures that contracts with these third parties mandate the confidentiality of Personal Information and adherence to the legal framework applicable to LinkNow®Media regarding personal data protection.

We do not sell, trade, or rent Personal Information to others without your consent. At your direction and with your consent, we may share Personal Information with third parties, such as online business directories to help promote your business. We may also share with business partners, trusted affiliates and advertisers generic aggregated demographic information not linked to any Personal Information regarding visitors and users.

We may share or transfer your Personal Information where reasonably required in the context of a sale, merger or amalgamation of all or part of our business, or the insurance or securitization of our assets. In any such case, the recipient parties will be contractually required to keep the information confidential and use it only for the purposes of the transaction, or proposed transaction, in question. In the event a business transaction is affected, assignees or successors of LinkNow®Media or our business or assets, or those of our affiliated entities, may use and disclose Personal Information only for the purposes as set out this Privacy Policy, unless further consent is obtained.

LinkNow®Media may also disclose Personal Information to respond to legal requirements, enforce our policies, or protect anyone’s rights, property, or safety, in accordance with applicable laws and regulations. We attempt to notify Users about legal demands for their Personal Information when appropriate, in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise, nor are we under any obligation, to challenge every demand.

We may also share your Personal Information with law enforcement, national security agencies or other governmental officials, as required or permitted by law, such as in response to a court order or a verified request relating to a criminal investigation or alleged illegal activity.

Further, with your consent, we may share Personal Information with third parties, such as online business directories, to promote your business. We may also share aggregated demographic information, not linked to any personal information, with business partners for analytics purposes.

In the context of a significant business transaction, like a sale, merger, or asset securitization, we may share or transfer your Personal Information. The parties involved will be contractually required to keep the information confidential and use it only for the purposes of the transaction. Subsequent use or disclosure of Personal Information by our assignees, successors, or affiliates will adhere to this Privacy Policy, unless further consent is obtained.

We may also disclose Personal Information to law enforcement, national security agencies, or other governmental officials as required or permitted by law, such as in response to a court order or a verified request related to a criminal investigation or alleged illegal activity.

How we protect your information

LinkNow®Media implements comprehensive policies and practices that are focused on corporate governance and the protection of personal information. The organization ensures that all personal information it manages is stored in secure locations, safeguarded by generally accepted practices. Access to this information is strictly limited to employees who require it to perform their job responsibilities.

We are committed to maintaining robust data collection, storage, and processing practices, alongside effective security measures. These are specifically designed to prevent unauthorized access, alteration, disclosure, or destruction of personal information, including usernames, passwords, transaction information, and data stored on our Properties, such as the Site. Our security measures, conforming to industry standards, include a blend of organizational, physical, and electronic safeguards.

Furthermore, LinkNow®Media routinely conducts Privacy Impact Assessments (PIA) for any project or situation that necessitates such an assessment under the relevant Act.

Our employees are thoroughly educated about the critical importance of protecting personal information. They are trained in procedures and measures that uphold the confidentiality of this information and are encouraged to adopt best practices in this domain as part of their professional responsibilities.

LinkNow®Media is dedicated to ensuring the protection of personal information right from the point of collection. We implement stringent security measures to guard against non-compliant usage, accidental loss, modifications, disclosures, unauthorized access, misuse, or any other illegal forms of use. However, it is important to note that while we strive for the highest level of security, absolute protection against every potential attack on personal information cannot be unequivocally guaranteed.

In instances of a confidentiality incident, or if there’s a suspicion of such an incident involving personal information, we adhere strictly to the applicable legal provisions. We take reasonable steps to mitigate the risk of harm to individuals affected by the incident. LinkNow®Media conducts a thorough investigation of any such incident or potential incident and follows our meticulously crafted Incident Management Plan. We are firmly committed to our legal and regulatory duties regarding the documentation and reporting of privacy incidents.

Retention and Storage

LinkNow®Media retains personal information only for as long as is necessary to fulfill the purposes for which it was collected, unless a longer retention period is authorized or required by the Laws or legislation applicable to LinkNow®Media or its professionals, including those of professional orders. In ensuring compliance with ethical, legal, tax, and accounting requirements, we adopt robust measures to manage the retention of personal information.

Upon the expiry of the retention period, we make all reasonable efforts to securely destroy and irreversibly delete both electronic and hard copies of personal information, in accordance with the Act and best practices. This includes anonymizing information such that it no longer allows irreversible identification of the person concerned.

However, it is important to note that when personal information is shared with third parties for specific purposes, such as payment processing, these third parties, including payment processors and financial institutions, may retain the information according to their own retention policies. LinkNow®Media does not have control over, nor responsibility for, the retention practices of these third parties.

Furthermore, LinkNow®Media may retain personal information even after account closure or subscription termination if reasonably necessary to comply with legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, or fulfill a request to "unsubscribe" from further messages from us.

The personal information we hold may be held or transferred outside the province of Quebec, including in countries other than Canada and whose rules regarding the protection of personal information differ from those of Quebec and Canada. When information is located outside Quebec or Canada, it is subject to the laws of the country where it is located so that it may be collected, retained, communicated, used or destroyed other than as required by the Laws.

Protecting children’s privacy

Protecting the privacy of the very young is a paramount concern for us. Consistent with the principles of the Children’s Online Privacy Protection Act (COPPA) in the United States and the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada, as well as other relevant child privacy legislations, we have established practices to safeguard the online privacy of children.

Our website is not designed to attract children under the age of 13, and we do not knowingly collect or maintain personal information from anyone we actually know is under 13 years of age. We take deliberate steps to ensure that our content and services are not appealing to children under this age threshold.

In the event that we become aware of having inadvertently collected personal information from a child under 13, we will take immediate steps to delete such information from our records. We uphold a strict policy against collecting or storing data from young users, reflecting our commitment to comply with the legal requirements aimed at protecting children’s privacy online.

Our approach emphasizes a strong stance against the collection or retention of personal information from young children, ensuring compliance with current US and Canadian laws on the topic.
